The Fair Debt Collection Practices Act (FDCPA) and California’s Rosenthal Fair Debt Collection Practices Act (Rosenthal FDCPA) was designed to keep debt collectors – whether from Glass Mountain Capital, GMC Credit Services or any other collection agency (Persolve, Portfolio Recovery Associates, Mandarich Law Group, Kenosian & Miele, Spiwak & Iezza, or others) – from harassing or abusing consumers. There is a lengthy list of things that they can and cannot do. For instance, debt collectors – whether from GMC Credit Services or any other collection agency – can only call a consumer at certain times—between 8 AM and 9 PM in the consumer’s time zone. In addition, debt collectors are not permitted to call so frequently that it constitutes harassment, and while the legislation don’t define harassment, calling more than once a day would seem to fit the bill.

In addition, a debt collector from whether from Glass Mountain Capital, GMC Credit Services or any other collection agency (Persolve, Portfolio Recovery Associates, Mandarich Law Group, Kenosian & Miele, Spiwak & Iezza, or others) is not allowed to talk to anyone else about your debt. In some states, they’re permitted to talk to your spouse. If you give GMC Credit Services the name of your attorney and ask them to communicate with him or her, GMC Credit Services isn’t allowed to talk directly with you anymore. If you aren’t allowed to receive phone calls at work, you can tell the debt collector, and according to the FDCPA, they must stop calling you there.

The Fair Debt Collection Practices Act gives you the right to take the debt collector to court if you can prove that he violated the provisions of the Act. Talk to a fair debt collection attorney, and if he thinks you have a case, file a suit. If you win, the judge can award you up to $1,000 in damages, plus force the debt collection agency to pay court costs and attorney’s fees.
